The book is framed within the framework of human rights, considering this group as the legal basis of a democratic and social State governed by the rule of law. The starting point is not only their declaration, guarantees and effectiveness, but also the recognition that they are the very reason for the existence of the Public Power. The work addresses the right to equality, put to the test by two categories - gender and sex - formally considered among the causes of unequal treatment. Although the social and biological reality shows distinctive elements among human beings, these categories are insufficient to separate the condition of person, since this condition is indivisibly and inalienably attached to every human being. Nor are they suitable factors that allow a rational alteration of the juridical sphere of rights and obligations. With this state of affairs, vox populi, it is worth reviewing once again the specialized studies on gender and sex, and to present the legal measures, analyzing their effectiveness in favor of equality.
