Excerpt from In the United States Circuit Court of Appeals for the Ninth Circuit<br/><br/>John O. Briscoe had no interest in any of said proper ties at the time of said sale, or since. The plaintifis all joined in the contract of sale, but the deeds of conveyance were executed bv the several owners as above set forth, three deeds being executed, one for each of the three groups specified. The contract of sale was merged in the deeds executed and delivered in fulfillment thereof. And thereupon the right of the plaintiffs to seek redress in this suit, if auv they had, ceased to be joint under the contract, and became several under their respective deeds.
