L'application des conventions internationales par le juge pénal national en Égypte, aux États-Unis et en France

Aux XIX^e et XX^e siècles, les premières avancées jurisprudentielles sur la question de l'application des conventions Internationales concernaient rarement le droit pénal qui était cantonné dans un cadre restreint telles les conventions d'extradition ou de piraterie. Ainsi, la théorie de l'application des conventions internationales a généralement été forgée hors de l'espace pénal, surtout par la doctrine de droit public et de droit international public ainsi qu'une jurisprudence non-pénale. L'internationalisation progressive et exponentielle du droit pénal a mis de l'eau dans le vin de la souveraineté nationale. Désormais, les traités constituent une source importante pour le droit pénal national.

Le caractère régalien du droit de punir s'érode et se contracte. Les juridictions répressives internes, sensibles à cette internationalisation, contribuent de leur propre Initiative à une influence grandissante des conventions internationales sur le droit pénal Interne. Au regard du fait qu'il est lié à la définition des valeurs sociales, qu'il est lourd de conséquences sur la liberté Individuelle, le droit pénal nécessite une inculturation en son sein de la théorie d'application des conventions internationales qui prend en compte ses caractéristiques, notamment le principe de légalité. L'étude comparée analyse le processus par lequel une source de droit pénal, commune aux États comparés, est accueillie par le système juridique interne et appliquée par le juge national. Avant de dérouler un effet sur les faits d'espèce, le juge pénal examine les conditions d'application des conventions internationales. Un traité applicable doit être conforme à une référence externe - la Constitution - comme il doit être doté d'une capacité intrinsèque à produire des effets dans l'ordre pénal interne. Une fois ces conditions réunies, le juge national libère l'effet enfermé dans la norme internationale. Les modalités empruntées par le juge pénal lui permettent de déterminer le champ d'application de la norme internationale par son travail Interprétatif. En dernière étape, les effets de la norme internationale sont matérialisés par des techniques d'application adaptées à l'effectivité pénale de celle-ci.

In the 19th and 20th centuries, the first advances in case law regarding the application of international treaties rarely involved Criminal Law which was restrained to a limited scope such as extradition or piracy treaties. Thus, the theory of the application of international treaties has been constructed outside the Criminal Law sphere, specifically by the efforts of Public Law and Public International Law doctrine as well as a non-criminal jurisprudence. The progressive and exponential internationalization of Criminal Law has watered down the concept of national sovereignty. Henceforth, Treaties are an important source for domestic Criminal Law. The regal character of the Right to Punish is eroding and contracting. Domestic criminal jurisdictions, sensitive to this internationalization, contribute by their own initiative in a growing influence of international treaties on domestic Criminal Law. In view of its role in the definition of societal values and its impact on individual freedom, Criminal Law requires an inculturation of the general theory of treaty application adapted to its characteristics, most clearly the principle of legality. The comparative study analyzes the process by which a source of Criminal Law, common to the States compared, is « received » by the domestic legal system and applied by the national judge. First, the criminal judge examines the application conditions of international treaties. To be applicable, a treaty must conform to an external standard - the Constitution -, as it must have an intrinsic capacity to produce effects in the domestic criminal system. Once these conditions are met, the national judge releases the effect enclosed in the international norm. The modalities followed by the criminal judge makes it possible to determine the scope of the international norm by the interpretive work. In the last stage, the effects of the international norm are materialized by techniques of application adapted to the criminal effectiveness of the latter.
